EPO Ends 10-Day Rule

What Has Changed?
The European Patent Office (EPO) has announced that its so-called “10-Day Rule” will end as of 1 November 2023.
The rule relates to the date on which a document sent by the EPO is deemed to be delivered. Previously, this was 10 days from the date on the document, but as of 1 November 2023, the date on the document will be deemed to be the delivery date.
Why Has The Rule Changed?
The Administrative Council of the EPO passed a package of rule changes intended to adapt to the digital age, with the majority of communications now taking place by email.
What Action Should You Take?
If you are the owner of a European Patent, have applied for a European Patent, or are in the process of opposing a European Patent, you should take particular care to factor the new rule into your timelines to ensure that no official response deadlines are missed.
