A trade mark is a word, slogan or logo used to distinguish the goods or services of one company or individual from those of another. Registering a trade mark provides strong protection for a brand.  Unlike other forms of registered intellectual property, trade marks can be renewed indefinitely.

A common strategy for protecting a trade mark involves filing an initial UK trade mark application and then extending protection to other countries within six months of the UK filing date. In doing so, the later filed applications can retain the benefit of the earlier UK filing date.

Filing a trade mark application may appear to be a straightforward procedure.  Indeed, many individuals and businesses choose to self-file applications without professional input. We would caution against this approach for the simple reason that there are many potential pitfalls, some of which can lead to issues which are expensive and time consuming to resolve.  Seeking professional advice at the outset will vastly reduce the risk of such problems arising.

An EU application includes only one class of goods/services.  A second additional class may be covered for £75 in our fees plus 50 EUR in official government fees. Further classes may be covered for £75 in our fees plus 150 EUR in official government fees.

The above fees exclude VAT and do not include professional advice and services in respect of overcoming any third party or Intellectual Property Office objections to the registration of your mark.  The above fees cover cases of normal complexity; in the event of any increased complexity then additional fees may be incurred.

Protection in Other Territories

In addition to the UK and Europe we can assist with trade mark protection in other worldwide territories.  Due to differing international trade mark protection regimes the best way for us to advise on this issue is for you to present us with a list of the territories in which protection may be required. We can then revert to you with information and advice tailored to your particular situation.  Please note that foreign applications may obtain the benefit of an earlier UK or CTM filing date if filed within six months of that earlier filing. It is therefore common to file only a UK or European (CTM) application at the outset and subsequently consider the filing of foreign applications at a later date.
